Not every divorce would benefit from mediation

The media tends to make it seem as though every couple needs to end their marriage amicably. Divorce mediation serves as a way to keep things relatively friendly and provide couples with a mutually satisfying settlement. That may sound nice, but mediation is not a “one size fits all” solution for every Sugar Land couple. In some cases, it would not be the right choice.

Not every couple agrees to a divorce. If one party does not want the divorce, mediation may not work. Instead, the petitioning party will more than likely need to rely on the courts to get the job done. Attempting to stay out of court will certainly not work if one party is actively attempting to hide assets from the other. Under these circumstances, the other party needs to power of the court in order to help uncover this deception.

Then there are cases in which a Sugar Land couple has a volatile relationship. If any kind of domestic abuse, including child abuse, exists within the household, mediation will probably not work. Instead, the abused party, and the children, would greatly benefit from the protection of the court in order to get out of the marriage with the chance of a better future.

These are just some of the reasons why mediation would not be appropriate in a divorce. In order for this alternative to a traditional divorce to work, both parties must be willing to compromise and agree to full disclosure. Under any of these circumstances, one party could end up at a disadvantage as he or she attempts to move on with his or her life.
